11-12-09 PUBLIC HEARING

Minutes from the public hearing of the Water and Sewer Authority held at the Waste Water Treatment Plant, 24 Commerce Road, Newtown, CT, on Thursday, November 12, 2009. Chairman Richard Zang called the meeting to order at 7:05pm
Present:  Marianne Brown, Lou Carbone, Richard Zang, Carl Zencey, Alan Shepard
Absent:  Rich Conte, Phil Cruz
Also Present:  Joe Tartaglia, Director of Public Works Fred Hurley, Jason O’Brien of AOS Operating System.
Set the benefit assessment for 26 Church hill road at $8,300 – No public Comment
Set the sewer benefit assessment for 105 Church Hill Road at $14,500.  This was amended from published amount of $25,000 - Mr. Tartaglia, owner of the property, asked why he is getting assessed again.  He paid once and his property is mixed used.  The current permit is for a shell permit, not for a restaurant.   He believes that he is already tied into the system and there should be no change.  The benefit to the property is generally the usage.  Mr. Zang read from the state statue regarding the benefit assessment.  Mr. Tartaglia doesn’t think that this benefit assessment is fair.  Mr. Hurley explained that a residential assessment is $9,900 for residential no matter how many bedrooms.  The only thing that this $14,500 refers to is the addition and the change in use.   Mr. Zang suggested that he put his argument in writing and that the WSA table the decision during the regular meeting.
